New York Penal Law § 175.10 defines the crime of falsifying business records in the first degree. It's a class E felony, meaning a conviction could result in up to four years in prison. Specifically, this crime is committed when a person falsifies business records, and their intent to defraud includes the intent to commit another crime or to aid or conceal the commission of another crime.

Yes, every one of them had an underlying felony. But not Trump. It’s not even a crime without an underlying felony.


Just so you understand. The 33 charges. 2 parties entered into a NDA (NonDisclosure Agreement) it is a very common legal agreement, most anyone with a career is a party to at least one NDA. Trump’s lawyer billed Trump 11 times for those legal expenses, the Trump AP recorded 11 entries for legal expenses and made 11 payments to President Trump’s lawyer for legal expenses. Those are the 33 counts. All of that is 100% legal without the 34th count which has to be a felony. It’s perfectly legal for me to record a bill for legal services as “grape nuts” or “lift rental” or whatever I want, it’s done all the time so long as it is not in the furtherance of an underlying felony. Also, paying for an NDA is a “legal expense”.


What was the 34th count?
