Hello Everybody,

I'm selling the brand new 48x24x24 with upgraded panels and overflow for $350 now. (I had to put it in this thread to justify posting in the classifieds section)

The "SCAM" comment in my title is a concern I have. One of my customers recently informed me of this website: http://www.ieaquariumfactory.com/store.htm (I sent him an email to change the info, but I don't know if he's done it or not yet). Here is his email: sales@ieaquariumfactory.com or carloscruz@jaycarholdings.com.

If you go to my website www.fishtankfactory.com you will notice that he/she copied much of the wording and also pictures. I'm not sure if they just needed some help starting a website or not, but come on? My website needs the most help out of all the sites, haha. Why copy me?

I'm just scared that there is an evil motive here to try and get a mixed identity.

I'm asking that everyone be on the lookout for me. I know internet scam is revelent and I don't want to get in the mix.

Send a Cease and Desist Letter

This will help you protect your IP

Dear [name]:

It has come to my attention that you have made an unauthorized use of my copyrighted work entitled [name of work] (the "Work") in the preparation of a work derived therefrom. I have reserved all rights in the Work, first published in [date], [and have registered copyright therein]. Your work entitled [name of infringing work] is essentially identical to the Work and clearly used the Work as its basis. [Give a few examples that illustrate direct copying.]

As you neither asked for nor received permission to use the Work as the basis for [name of infringing work] nor to make or distribute copies, including electronic copies, of same, I believe you have willfully infringed my rights under 17 U.S.C. Section 101 et seq. and could be liable for statutory damages as high as $150,000 as set forth in Section 504(c)(2) therein.

I demand that you immediately cease the use and distribution of all infringing works derived from the Work, and all copies, including electronic copies, of same, that you deliver to me, if applicable, all unused, undistributed copies of same, or destroy such copies immediately and that you desist from this or any other infringement of my rights in the future. If I have not received an affirmative response from you by [date give them about 2 weeks] indicating that you have fully complied with these requirements, I shall take further action against you.

Can I consider my work copyrighted? They are just a bunch of pictures I took from the warehouse.

The acrylic pictures I don't mind as they are pics Clear for Life gave me.

As I mentioned on a few other forums, he changed most of the pictures except for a few.

The wording is still almost identical. Again, to make it clear...I have no problem with a new business starting up. Just in case there is a scam...I don't want someone looking at my amateur website and his amateur website and seeing close similarities and associating me with him. I work with several builders/suppliers down here and a few of his prices (I.E. The aquarium packages) are kind of odd. Nothing wrong with having low prices, but when he is clearly claiming to be the middle man, to include a stand and canopy at those prices, they'd have to be made out of paper.

Just make sure before you buy from someone you ask to go and see them in person also their work. Safest. Another forum I am on is dealing with a scam artist right now - hence my passion...

I have a few customers on RC looking out for me also.
