My first apex failed as I had been shipped an item that was water damaged.

Now after 14 months my EB8 has a faulty outlet.

Neptune have refused to accept that despite numerous similar issues that there is a problem with the unit. They will of course charge me to repair it!

Despite numerous emails back and forth my EB8 is still faulty and when you advise them of their failings under CA Code and the law they become abusive.

There are numerous threads on their own forum about this issue but now I have been banned from their forums because I have made a fuss and brought this to the public attention.

After days of emails and no resolution, but a representative stating that "For me and all of my equipment it is never a matter of "if" but always a matter of "when," I am left with a still non functioning EB8.

Neptune have also refused to follow the law and provide repair information as required under CA Code. In view of this it is my intention to start court proceedings against Neptune Systems for selling a product which isn't fit for purpose and for their breach of the CA Code.

In addition to this they have been both insulting and rude.

Should anyone wish to provide supporting statements in support of the clear issue with the EB8 outlets then please email me at sdgander1@hotmail.com. The successful court case will ensure that they are required to publicly release the repair information for the Apex. This means you can repair the item yourself or have a local electronics shop repair it instead of paying their charges to fix a piece of equipment that is not fit for purpose.

I will not let his matter rest until Neptune are held accountable for the failings of their equipment and attitudes of their staff.

I WILL be taking this matter before the courts and of course the court records will be public information.

That sucks to hear I love my apex. I am not familiar with the code and don't quite understand what you mean about it. Are you saying they are legally obligated to publicly release repair instructions so that you are not forced to have them repair it?

Basically yes!

Advised by the BBB that this is the case. They initially denied this then when I called them out on it agreed to provide the information if I signed a disclaimer or paid for a new board.

The VP has since become offensive and rude. They have banned me from their forum which shows others having the same problem and deleted my Facebook posts - if that isn't denying the issue and hiding it I don't know what is.

I will have my day in court and given my previous experience and back ground I am confident they will lose and have to make the repair information public knowledge.

Good for you man! It makes me happy to see people research and use the law instead of just complaining about it. But I do love my apex.

I won't let anyone walk over me - Neptune are a small company compared with some I have won cases against. I spent a while in a law enforcement role previously so have a minute attention to facts and details. I have lost 1 case out of 14 so far... I have no intention of making it 2.

Steve - I brought it new, it failed after like 24 hrs so was returned as a complete set up and 'found' to have been contaminated with salt water - after pointing out that it hadn't got wet here it was replaced - that was December 2012. This is the replacement unit which has failed.

There are 4 similar posts with the same issue on their Energy Bar Forum in the last 3 weeks alone...

My initial unit was shipped with water damage, the replacement EB8 has failed after 16 months. There was a 'cover up' with the initial unit being damaged and as such replaced FOC despite the seller trying to blame me for getting it wet - I think I posted here at the time,

Ok so, your main grievance is that they won't give you the necessary information on how to repair it yourself? Right? Or what is the other issue?

The issue is they sell a product with a repetitive multi-user fault but deny there is a problem but will happily charge [you] to fix the problem they will not admit too.

When you bring this to their attention they become abusive and unhelpful.

1. I shouldn't need to be fixing this fault - period. After just four months out of warranty.
2. They should not be charging to fix what is clearly a problem with the product they sell. They should fix the problem and stop selling the EB8 with this known issue.
3. They should not ignore their legal requirement to allow the user to fix the problem with their product without paying them to fix their inherently defective product.

To me the fact they would rather delete my postings as opposed to answering them honestly and openly simply confirms they are aware of the issue but want to hide it rather than resolve it.

I am fortunate that I have an email from them which clearly states they expect it to fail.

So please explain the other side of the coin as you see it.

One issue - resolved. But I should have never been shipped the water damaged unit EVER! They basically accused me of lying saying I MUST have damaged it or got it wet - they then claimed that the supplier was covering the cost.

Second issue NOT resolved along with multiple other users. AND Neptune denying this issue exists and failing to resolve it and instead choosing to delete my posts and getting abusive because someone stood up to them.

There are at least 4 other posts in their Energy Bar forum with the same issue in the last 3 weeks!

Do NOT let ANY company bully you into accepting their resolution - especially if you have the law on-your side. Bullies will continue bullying until someone stands up to them.

I really like my apex and have had good experience with their customer service. With that being said, I know ppl with bad experiences with them. I can fully understand PW side of the story. I think a lot of ppl are going to get upset when u tell them something they love may mess u up later. Brand loyalty. David went thru their warranty 3 times and sent the base into back and forth and charged him twice for it. First they said it had a dirty connector, then they said a bunch of other stuff. It shoulda been fixed the first time is the way I see it.

Which outlet went out? My apex also has an outlet that stopped working. It works but is uncontrollable. It is number6. I've read that other people have had the same outlet go out. I'll send it in one day to get fixed but too lazy to disconnect everything

True, I tell people all the time, no one is going to help you if you're an a-hole whether you are right or wrong.

pW- I am not calling you an a-hole, I am just wondering how the conversation went. I see they did correct their error the first time, the second time I do see how they would have known the error and not wanted to fix it. I also have an outlet that is not working correctly

Neptune systems has shotty CS and are very bad with responses. My work is a distributor and we ordered a ton of stuff about a month ago and it still has not shipped. Standard protocol from Neptune systems is 2-4 weeks to ship from date of order.

How is he going to post pics if thing that were deleted. It's not like he know knew they were going to banned him and delete his posts. Come on McFly, think about. Don't attack the guy for having a legitimate claim. I've heard of a lot of people having ports go out. When u pay 500+ dollars for an item you should b able to depend on the dam thing to work right.
