What rental company? My cousin services the Enterprises out here and he has to place new tires if the tread is less than 60%. They are thorough on tire inspections. Also enterprise rarely rents cars with more than 30k miles.

It was Hertz. And I've done some research online and it sounds like they do this to people a lot and when people refuse to pay, they send it to collections and screw their credit.

To make it even worse, when it happened, I called the Hertz Roadside Assistance and they said they'd come out and put on the spare but they were gonna charge me $78!

Needless to say, I will never rent from Hertz again and I hope others will hear my story and others like it and do the same.

Don't let them get away with it! Write a strongly worded letter to their customer service/complaint department saying any charges made against you will be reclaimed via the small claims court as they are clearly negligent in the maintenance of their vehicle and that should it be necessary to take that route you will be presenting photographic evidence of this to the judge.

Also tell the credit card company that you used as security that due to the fraudulent claims being made by Hertz that no future charge from them are authorized by you and you withdraw any previous authorizations to them due to breach of contract.

Keep the contract. READ it closely and any relevant parts regarding their liability to the renter regarding tires should be fully quoted in the letter to Hertz.

As for the ticket can you contest it as invalid due to not being correctly completed? I know you can in the UK. BUT even if it was 70 you were still 10% above the limit! ;) Next time look dumb, smile sweetly then cry lots...

Those tires look like someone did a "swap out" IMO. Still Hertz is suppose to do an inspection "lobr" lube, oil, brakes, and rotation. And clearly the guy who was to rotate the tires should have replaced that tire.

In the industry they say " buddy, that tire is so bad you can't even use it for a swing."

Lol... a$$ hole.
I do think I could use some therapy after last weekend on top of being stuck in LA.

Pics of the tire... it barely had any tread left on it, the rubber was very dried out and cracked like it had been sitting in a parking lot in Phoenix for an extended period of time, and it had a previous plug right near where the split started.
I just feel lucky that it didn't happen late at night somewhere in between my house and NOLA!
And grateful to have such good reef buddies that they will leave work to come change a tire for me!

Good tire for pic comparison with the same camera:
So I just got a call from Hertz.... They're charging me $287.00 for the tire damages. And she was very rude!:mad::mad::mad::mad:

Go to better business bureau and report Hertz. show the pics to. If they charge you $287.00 then dispute the charge and explain to your CC company why.

I'm an ASE certified master tech in automotive and currwntly hold 4 certs in medium/heavy truck and have been a mechanic for more than 20years.
My professional opinion after seeing the pics is that they are in the wrong and negligent on their inspections. In Cali your allowed treadwear down to 2/32" before the tire is considered bad. That measurement is anywear on the tread area. Looking at the pictures I can see the tread near the outside of tire is actually worn past the wear bar. This means the tire was bad at the time you rented the car. Also, tire plugs are no longer allowed to be used to repair a tire as the installation of the plug tends to cause more damage to the tire in the form of belt seperation. I would first go talk to the manager of the store you rented the car from and show them the oics i f the tire. Usually they just go by want their mechanic says without looling for themselves and somebof those people doing the inspections don't know what their doing.
I also suggest you write a letter to their corporate offices and include pictures of the tire as well as the address or location number of the store. Also inform your credit card company and unauthorize any past and future charges to the rental company.
I would also seek out a reputable mechanic or tire shop in your area and show them the pictures and see what they have to say.

I will download and highlight the wearbar and repost the pic for you so you can see what I see

Fight the ticket anyways Lindsey! You never know, if they omitted location then that could be a flaw in itself forcing the ticket to be dismissed. If not, then the cop will have to produce the location and one that is at 60mph.
